Health & Safety Acknowledgement

I, the undersigned, understand that the use of the sauna, cold plunge, and tanning bed involves significant physical stress. I represent that I am in good physical condition and have no medical reason or impairment that would prevent my safe use of these facilities.

I acknowledge that I should consult a physician before use, especially if I:

• Are pregnant or nursing.

• Have cardiovascular disease, low/high blood pressure, or diabetes.

• Are using medication (particularly those that affect heart rate or blood pressure).

• Have a history of fainting, dizziness, or heat/cold sensitivity.

• Abnormal skin sensitivity to ultraviolet radiation or burning may be caused by certain foods, cosmetics, or medication, including, but not limited to, the following:

• Tranquilizers;

• Diuretics;

• Antibiotics;

• High blood pressure medication;

• Birth control medication; and

• Other photosensitizing agents

Specific Risks & Rules

Participant Agreement

1. I agree that I will comply with all instructions on the use of the UV system, sauna, and cold plunge and that I am using these services at my own risk.

2. I agree to hold harmless Delta Wellness LLC, its employees and agents for any injury to person or property in any way by the use of its premises and services. In addition, they are not liable for the loss or theft of any personal property. Each person is responsible for safeguarding his or her own property.

3. Purchaser agrees to use all sessions within the terms of the contract dates and understands that refunds are never given on unused portions of tanning, cold plunge, and sauna packages for any reason.

4. I understand that it is against policy to use more than one indoor tanning bed in one day.

Waiver of Liability

I, for myself and on behalf of my heirs, hereby release and hold harmless Delta Wellness LLC dba Valor Gym, its owners, officers, and employees from any and all liability, claims, or causes of action arising out of my use of the sauna, cold plunge, or tanning bed. This includes, without limitation, injuries resulting from:

1. The negligence of the gym or its staff.

2. The malfunction of any equipment.

3. My own failure to follow posted safety rules and duration limits.

4. Slip and fall accidents in wet areas (sauna/plunge zones).

Indemnification

I agree to indemnify Delta Wellness LLC dba Valor Gym for any loss, liability, or damage they may incur due to my presence in or use of these facilities, whether caused by my negligence or otherwise.

My signature below constitutes my acknowledgment that:

1. I have read, understand, and fully agree to the foregoing Waiver, Release and Consent,

2. The proposed indoor sun tanning process has been satisfactorily explained to me and I have all of the information I desire and

3. I hereby give my authorization and consent which shall continue in effect as long as I tan with any facility location now and in the future. I have read the instructions for proper use of the tanning facilities and shall use such tanning facilities at my own risk. For and in consideration of said being allowed to use the facilities of Delta Wellness LLC dba Valor Gym, I  hereby release Delta Wellness LLC dba Valor Gym, its directors, officers,  and employees from all liability to me for any loss or damage to property or injury or death time whether caused by Releasees or otherwise that result, directly or indirectly from the use by me of the tanning facilities of Delta Wellness LLC dba Valor Gym. I further agree to indemnify, save and releasees hold harmless from any loss, liability, attorneys’ fees, damage, or costs that they (or any of them) may incur arising out of or related to the use by me of the tanning facilities of Delta Wellness LLC dba Valor Gym whether caused by the negligence of the releasees or otherwise.

Signature

I have read this waiver in its entirety and understand that I am giving up substantial legal rights by signing it. I sign it freely and voluntarily.

Equipment Care Policy: Rack It, Wipe It, Respect It 

At Valor Gym, we want to maintain a clean, organized, and safe environment for everyone. Members are expected to properly handle and return all gym equipment and accessories after use.

Member Responsibilities

• Return all weights and equipment to their designated areas.

• Keep workout areas and walkways clear.

• Clean equipment after use.

• Use equipment properly and as intended.

• Report damaged or malfunctioning equipment to staff.

Equipment Fines

To help maintain a clean and organized facility, the following fines may apply when a member leaves weights, accessories, equipment, or other items improperly stored:

*Repeated offense/violations may result in additional fines and/or suspension or loss of gym privileges.

Important Reminder - If you use it, put it back.

Member Acknowledgment

By signing below, I acknowledge that I have read and agree to follow Valor Gym’s Equipment Care Policy. I understand that I am responsible for properly using and returning equipment and may be charged for damage caused by misuse or negligence.

I agree to help maintain a clean, organized, and safe environment for all Valor Gym members and guests.
